Terms and Conditions

1) Scope

The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions conducted via the online shops. www.bona-shop.ch These terms and conditions apply to all purchases made through the online shop (hereinafter referred to as "Online Shop"). Roombastic AG reserves the right to amend these terms and conditions at any time. The version of these terms and conditions in effect at the time of the order shall apply. By ordering goods or services, these terms and conditions are deemed accepted. The buyer's general terms and conditions of purchase are hereby rejected. Deviations from these terms and conditions are only valid if confirmed by us in writing. The offer of products and services in the online shop (hereinafter referred to as "Offer") is exclusively directed at customers with a residence or registered office in Switzerland or Liechtenstein. Deliveries are made exclusively to addresses in Switzerland or Liechtenstein. The offer is valid as long as the product is available in the online shop and/or stock lasts.Orders in non-household quantities can be rejected without justification.

2) Information

2.1) Product and price

Images of products in advertisements, brochures, online shops, etc. are for illustrative purposes only and are not binding. The information about products in the online shop is compiled in the most customer-friendly way possible, but is not binding. Manufacturer information (e.g., manufacturer's warranty) is authoritative, provided it is valid in Switzerland. Prices are net, in Swiss francs, including value-added tax (VAT), plus shipping costs unless otherwise agreed. Roombastic AG reserves the right to change prices at any time. For in-stock items, the price at the time of the order applies. In the event of delivery bottlenecks or errands, the current price on the day of the order applies.

2.2) Availability and delivery time

Roombastic AG attaches great importance to providing up-to-date and accurate information on availability and delivery times in its online shop. However, delivery delays may occur, particularly due to production or delivery bottlenecks. All information regarding availability and delivery times is therefore subject to change without notice.

3) Conclusion of contract

The products and prices in the online shop are considered an offer. However, this offer is always subject to the condition that the contract is terminated if delivery is impossible or if the price is incorrect. The contract is concluded as soon as the customer places an order in the online shop, by telephone, or by email (hereinafter referred to as the "Contract"). The customer will be notified of the receipt of an online order via an automatically generated order confirmation sent to the email address provided. Receipt of the automatically generated order confirmation does not constitute a guarantee that the product can actually be delivered. It merely informs the customer that the order has been received by the online shop and that the contract has been concluded subject to availability and the correct price.

4) Delivery date

In principle, products in the online shop are delivered from stock within 48 hours. If this cannot be met due to supply bottlenecks or other reasons, and restocking takes more than two weeks, the customer will be notified in writing or by telephone. Otherwise, backordered items will be delivered to the customer upon receipt, without notice from the customer.

5) Delivery

Orders with a value of CHF 150 or more are shipped free of charge. Orders with a value of CHF 150 or less will incur a shipping charge of CHF 8.90. The delivery address must be registered in Switzerland or Liechtenstein and with the post office. If this is not the case, the customer will bear any resulting costs. If the customer does not accept the ordered products at the specified delivery address, Roombastic AG may terminate (cancel) the contract and invoice the customer for the resulting delivery costs.

6) Obligation to inspect

The customer must immediately inspect delivered or picked-up products for accuracy, completeness, and any damage. In the case of freight forwarding, any damage must be reported directly to the driver so that the damage can be claimed from the freight forwarder. Damaged deliveries, incorrect, or incomplete deliveries must be reported to Roombastic AG within 8 calendar days. The customer may not use such a product and must store it in its original packaging as received until Roombastic AG contacts the customer.

7) Transfer of risk

The risk is transferred to the customer as soon as the shipment has been handed over to the company responsible for delivery. If shipping is delayed or becomes impossible through no fault of our own, the risk is transferred to the customer upon notification of readiness for shipment. Any agreement on Roombastic AG's assumption of transport costs in individual cases does not affect the transfer of risk.

8) Warranty

The warranty period is two years, unless otherwise expressly agreed in writing. If the manufacturer's warranty exceeds the warranty provided by Roombastic AG, Roombastic AG will also grant this extended warranty to the customer. The warranty period begins on the delivery date. Any warranty is void if our operating or maintenance instructions are not followed, modifications are made, parts are replaced, or consumables are used that do not conform to the original specifications, insofar as the defect is attributable to these actions. This also applies if the defect is due to improper use, storage, or handling of the equipment, or to unauthorized modifications or opening of the equipment. Minor deviations from the warranted characteristics of the goods do not give rise to any warranty claims. Liability for normal wear and tear, as well as for consumables/accessories, is excluded. Warranty claims against Roombastic AG are available only to the direct purchaser and are not transferable.

9) Liability and exclusion of liability

Liability is governed by applicable statutory provisions. However, Roombastic AG shall under no circumstances be liable for slight negligence, indirect and consequential damages, lost profits, unrealized savings, damages resulting from delayed delivery, or any acts or omissions of Roombastic AG's employees, whether contractual or non-contractual.

Roombastic AG is not liable for damages resulting from any of the following causes:

• improper, non-conforming or unlawful storage, setting or use of the products;
• Use of incompatible spare parts or accessories (e.g. power supply);
• failure to maintain and/or improper modification or repair of the products by the customer or a third party;
• Force majeure, in particular natural disasters, moisture, falls and impact damage, etc., for which Roombastic AG is not responsible, and official orders.

The service provider commissioned with the execution of the work is liable for defects, delays in performance and damages that arise during the execution of the work (e.g. on-site installations).

10) Payment

10.1) Payment options

Payments must be made in Swiss francs.

Cash payment is only possible if you pick up your order from our central warehouse at Däntschgass 2, 4803 Vordemwald.

Online banking, bank/postal transfer, credit card (Mastercard, Visa, Paypal, Postfinance), and cash on delivery are accepted as payment methods.

If you pay by credit card, the amount will be debited when you place your order.

With advance payment, delivery will only take place after receipt of payment. If payment is not received within 14 days of placing the order, Roombastic AG reserves the right to cancel the order.

10.2) Default in payment

If the customer fails to meet his payment obligations in whole or in part, all outstanding amounts owed by the customer to Roombastic AG under any title shall become due immediately (in the case of advance payment within 10 calendar days of the first reminder) and Roombastic AG may demand payment immediately and cease further deliveries of products to the customer.

10.3) Retention of title

Ordered products remain the property of Roombastic AG until full payment is received. Roombastic AG is entitled to make a corresponding entry in the retention of title register. Prior to transfer of ownership, pledging, transfer by way of security, processing, or modification is not permitted without the express consent of Roombastic AG.

11) Change of order or cancellation

Orders oblige the customer to accept the products and services. Roombastic AG may accept subsequent changes or cancellations of customer orders at its sole discretion.

If a (partial) delivery impossibility occurs after placing an order or concluding a contract in accordance with section 3), the customer will be notified immediately by email. If the customer has already paid, this amount will be refunded. If no payment has been made, the customer is released from the obligation to pay. Further claims due to delayed or non-delivery are excluded.

12) Returns

Goods can only be returned if there is a fundamental defect. Please contact customer service first to learn more about the exact procedure.

13) Further provisions

13.1) Partial invalidity

Should individual provisions of these Terms and Conditions be invalid or ineffective, this shall not affect the validity of the remaining provisions and these Terms and Conditions as a whole.

13.2) Place of jurisdiction and applicable law

All legal relationships between Roombastic AG and the customer are governed by Swiss substantive law. The place of jurisdiction is Cham, Canton of Zug.
